Welcome to the Dakota Spirit website. By accessing, browsing, registering, or making a purchase on this site, you agree to the following Terms & Conditions. If you do not agree, discontinue use immediately.

These terms apply to all users, including parents, athletes, visitors, and customers.

1. Use of This Website

You agree to:

• Use this site for lawful purposes only

• Not attempt to disrupt, harm, or hack the site

• Not copy, scrape, or repurpose content without permission

• Not engage in fraudulent or misleading activity

Dakota Spirit may restrict or remove access at any time for any reason.

2. Intellectual Property

All content on this website—including text, logos, graphics, photographs, documents, and design—belongs to Dakota Spirit or its content providers and is protected by U.S. copyright and trademark laws.

You may not:

• Copy, distribute, modify, or repost content without written consent

• Use Dakota Spirit branding, logos, or program names without permission

3. Online Purchases & Transactions

By purchasing products, programs, or memberships, you agree to:

• Provide accurate billing and contact information

• Authorize Dakota Spirit to process charges to your payment method

• Accept posted pricing, policies, and program rules

Dakota Spirit may refuse or cancel orders at any time, correct pricing errors, or limit product availability.

Preorders and marked final-sale items are non-refundable and not eligible for exchange.

4. Program Registration

Enrollment in Dakota Spirit classes, clinics, teams, and camps is subject to:

• Program requirements

• Timely payment

• Completion of required forms and waivers

Dakota Spirit may remove an athlete from a program for nonpayment, repeated policy violations, unsafe behavior, or conduct that negatively affects others.

5. Program Participation Waiver

By participating in Dakota Spirit programs, you voluntarily agree that:

• Cheerleading, tumbling, and related activities carry inherent risks, including falls, injuries, illness, and accidents

• You assume full responsibility for any injury or harm that may occur

• Dakota Spirit, its staff, and affiliates are not liable for injury, illness, property loss, or death resulting from participation, except in cases of proven gross negligence

• You authorize Dakota Spirit to obtain emergency medical care if needed and agree to cover all related costs

You may be required to sign additional waivers during registration.

6. Media Release

By participating in Dakota Spirit programs or events, you grant permission for Dakota Spirit to:

• Photograph or record athletes during practices, events, competitions, or appearances

• Use these images and recordings for marketing, social media, print, video, or promotional purposes

• Use first names, team names, or general identifiers if needed

You waive all rights to compensation, royalties, or approval of produced content.

If you need to opt out for safety or legal reasons, you must notify Dakota Spirit in writing before participation begins.

7. Code of Conduct

Dakota Spirit athletes, parents, and spectators are expected to:

• Demonstrate respect for coaches, teammates, officials, and staff

• Follow safety rules and instructions from coaches

• Use positive language and behavior at all practices, games, and events

• Refrain from harassment, bullying, or disruptive conduct

• Support a drug-free, alcohol-free, and tobacco-free environment

Dakota Spirit reserves the right to remove any participant or family that violates conduct expectations—without refund.

8. Automatic Billing & Payment Terms

By enrolling in any recurring program, you acknowledge that:

• Tuition, program fees, or membership dues may be billed automatically on a recurring basis

• It is your responsibility to keep your payment method valid and up to date

• Failed or declined payments may result in late fees or loss of program eligibility

• Dakota Spirit reserves the right to use third-party billing providers to process payments

You authorize Dakota Spirit to charge your stored payment method until your enrollment is canceled per policy.

9. Refund & Cancellation Policy

• Preorders are final sale.

• Garments may be returned within 14 days if eligible and unworn.

• Tuition, registration fees, and deposits are non-refundable unless otherwise stated in writing.

• Missed classes, athlete absences, injuries, or scheduling conflicts do not qualify for refunds.

• If Dakota Spirit must cancel a class or program, alternate options or account credit may be offered, but not guaranteed.

• Refunds, when issued, will be processed back to the original payment method.

10. Assumption of Risk

You acknowledge that:

• Participation is voluntary and inherently physical

• Dakota Spirit is not responsible for injuries, lost personal items, or accidents

• You understand the risks and agree to participate willingly

11. Limitation of Liability

To the fullest extent allowed by law, Dakota Spirit is not liable for:

• Direct, indirect, incidental, punitive, or consequential damages

• Injury, property damage, data loss, or financial impact arising from site use or program participation

• Service interruptions, technical failures, or security breaches

12. Privacy & Data Use

Dakota Spirit collects personal information for communication, registration, and processing purposes.

We do not sell personal information and only share it as needed to:

• Complete online transactions

• Comply with legal requirements

Use of your information is governed by our Privacy Policy.

13. Third-Party Links

This website may link to external resources; Dakota Spirit is not responsible for their content, accessibility, or security.

14. Website Accuracy & Availability
